To the fullest extent permitted by law, Motivf and its officers, directors, employees, affiliates, contractors, partners, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or relating to your use of, or inability to use, the Site. To the fullest extent permitted by law, the total liability of Motivf for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

You agree to indemnify, defend, and hold harmless Motivf and its officers, directors, employees, affiliates, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms or misuse of the Site.

Your use of the Site is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the Effective Date above. By continuing to use the Site after updated Terms are posted, you agree to the revised Terms.
